A recent analysis of statistical data by the personal injury law firm Anidjar & Levine emphasizes the vital importance of seatbelt use in preventing injuries and fatalities in car accidents and its significant influence on insurance claims and premium costs.
The study reveals that not wearing a seatbelt not only dramatically increases the risk of serious injury or death but may also lead to higher insurance rates and potential denial of claims.
According to the firm’s review of data from the National Highway Traffic Safety Administration (NHTSA), a total of 25,420 passenger vehicle occupants were killed in traffic accidents in 2022. Nearly 50% of those fatalities involved individuals who were not wearing seatbelts at the time of the crash.
In addition, young adults between the ages of 18 and 24 are the least likely to wear seatbelts, putting them at greater risk of serious harm or fatal outcomes in collisions.
Some key findings from the firm’s statistical analysis include the following:
- The firm’s examination of data from the Centers for Disease Control and Prevention (CDC) shows that seatbelts reduce the risk of serious crash-related injuries and fatalities by approximately 50%.
- By analyzing data from The Zebra, the firm discovered that not wearing a seatbelt can raise auto insurance premiums by up to 29%, depending on the state.
- Additional findings from The Zebra indicate that seatbelt violations are categorized as moving offenses, which can remain on a driver’s record for three years.
Insurance companies frequently consider whether a seatbelt was worn at the time of an accident when determining claim outcomes. Some insurers may reduce compensation or even deny the claim if a driver or passenger was unbuckled. Additionally, certain states take seatbelt usage into account when assigning fault in personal injury cases. Neglecting to buckle up can significantly impact your ability to recover full compensation after an accident.
“The findings from our study unequivocally demonstrate the critical importance of seatbelt usage in mitigating both the physical and financial repercussions of car accidents. Not only does wearing a seatbelt significantly reduce the risk of severe injury or fatality, but failure to do so can also lead to substantial financial liabilities, including higher insurance premiums and potential claim denials. We aim to ensure that all drivers and passengers are fully aware of the legal and financial implications of not wearing a seatbelt and to advocate for stricter enforcement of seatbelt laws to enhance public safety.” – Anidjar & Levine.
The study advocates for stronger seatbelt law enforcement and continuous public awareness campaigns to increase compliance. States that strictly enforce seatbelt regulations tend to have higher usage rates and lower fatality numbers.
With increased cooperation between motorists and policymakers to promote seatbelt use, communities can benefit from safer roads and fewer financial and legal complications resulting from avoidable traffic incidents.
