“I think that’s a school decision, it’s a local community decision,” DeVos told the House Education Committee on Tuesday. Advocacy groups were quick to point out that her answer flies in the face of court decisions entitling all children to free public education, independent of their immigration status. That wasn’t the only time on Tuesday that DeVos raised hackles. When Rep. Jared Polis (D-Colo.) asked her to weigh in on how to best protect LGBTQ students from discrimination and harassment, DeVos said that she was committed to protecting civil rights but that courts had a mixed record on transgender students. “I am not going to make up law at the Department of Education,” she said. Social media users are livid, with many saying that DeVos failed to answer the question. Opinions around the Secretary are deep in the negatives, with 87 percent of social media users giving DeVos a failing grade. –Hugo Guzman
