Divorce can be a complicated situation, especially when children are involved. Most people do not know what to expect when they first start filing the papers. A lawyer is usually a necessity for these cases, as there is quite a bit of disagreement over property and custody. It can often take several months to complete the entire divorce process. Patience and a clear head is an important part of making it through this journey.
The Beginning
When you decide that a divorce is the best thing for you, paperwork must be filed. Usually, one spouse files papers before the others. There are, however, times when both are in agreement and file together. The papers are then delivered to the party that did not file. The papers must be signed and reviewed by the lawyers.
Temporary Orders
There are times when some sort of organization needs to be put in place immediately. This is usually the case when there are children. One spouse usually stays with the children or leaves with them before papers are ever signed. There is nothing in place during this time saying who has custody, or limiting visitation. There is often a meeting at the courthouse to put these in place. The lawyers may talk to each other so that the couple does not get into an argument. At this point, they just need an agreement that both people can agree with for a few weeks until more formal events take place. A few things that may be put into place are as follows.
- Temporary custody of children
- Temporary visitation schedule
- Stipulations for adults, such as drug testing or psychological evaluations
- Temporary monetary support of children or spouse
- Use of home and vehicles
Mediation
The courtrooms are often crowded, and your case may not be heard by a judge for several weeks if you decide to have a formal hearing. Mediation is a method of trying to get couples to compromise on some of the difficult subjects of the separation. This leaves less confrontation for the final court date. Many people stand strong on what they want and allow the judge to make the decision instead of settling in mediation. There are standard custody arrangements in most states. These may be modified or refused by a parent in mediation. Situations that involve physical abuse or addiction can be more difficult to work around. The judge needs to hear these statements and review evidence. The parties are in separate rooms with their lawyers for mediation. An objective party goes back and forth to share information.
Court
The courtroom is usually your final stop in the divorce proceedings. You are to be present with your lawyer in the courtroom. Your spouse is also there with a lawyer. When your case is called, the judge intervenes and makes decisions on the various points. Your lawyer can also speak up on your behalf. Once this is done, your paperwork is drawn up and you are officially divorced.
Divorce can be a stressful and emotional time for all parties involved. It can help to know what to expect before you file your papers. Your lawyer can also help you navigate the process. Be sure to take your time and read through everything before you sign papers. Once the divorce is over, take your time getting used to your new life. Be kind to yourself and supportive of your kids.
